The decision. The Provisional Electoral Council modified the criteria of the electoral decree by canceling the automatic exclusion of candidates hit by international sanctions. This regulatory revision allows figures targeted by punitive measures decided abroad, as well as independent candidates, to run in the upcoming elections. |
Those concerned. Among the citizens likely to benefit from this modification are former president and singer Joseph Michel Martelly, former president Jocelerme Privert, former prime minister Jean-Henry Céant, and former president of the Chamber of Deputies Gary Bodeau. The third electoral decree of June 2, 2026 also removes the requirement to present a bank certificate regarding the freezing of assets. |

The warning. According to Pierre Espérance, executive director of the National Human Network for the Defense of Human Rights, the Provisional Electoral Council will have to bear the consequences if Michel Martelly's presidential candidacy is validated. He evokes the sanctions imposed by Washington and Ottawa against Martelly for his alleged ties to drug trafficking and armed gangs, while recalling that electoral legislation does not mention these specific sanctions. |
The next steps. The Provisional Electoral Council affirms its willingness to conduct an inclusive, impartial, transparent, and responsible process, while clarifying the rules for independent candidates. For his part, Pierre Espérance questions the institution's responsibility regarding a potential validation of the former president's candidacy. |
