Fils-Aimé must publish the Constitution before September 14
Interim Prime Minister Alix Didier Fils-Aimé is being ordered to publish the text of proposed constitutional changes by no later than September 14, according to his own decree. Article 194 stipulates that these modifications must be made public "no later than ninety (90) days before the date of the vote." The popular consultation is scheduled for December 13, 2026.

Legal Challenges
The electoral decree imposes strict requirements, but it conflicts with Article 284-3 of the Constitution, which formally prohibits any constitutional change by referendum. Dr. Elco Saint Amand and Me Claudy Briend Auguste point out that the government must justify how its mechanism can survive this prohibition.
Publicity and Debate
Article 195 of the decree requires the Executive to inform the population about the content of the proposed changes. However, with less than two months before the deadline, citizens remain in the dark about the exact text they will be asked to approve or reject.
Implications
If the constitutional project is not published by September 14, it will result in a violation of Article 194. Furthermore, with only 6.1 million citizens registered on the electoral rolls, the credibility of the process is already compromised.
