According to the Argentine prosecution, Luque is accused of simple homicide with eventual dolo (conscious awareness of the risks). The same charge applies to Nancy Forlini of Swiss Medical and Agustina Cosachov. For these three individuals, the requested sentences are 10 years in prison and a professional ban for Forlini, as well as eight years in prison and a ban for Cosachov.
The other defendants, Carlos Díaz (psychologist), Mariano Perroni (head nurse), and Ricardo Almirón (nurse), are being prosecuted for negligent homicide. For them, the requested sentences range between four and five years in prison along with a professional ban.
Prosecutor Patricio Ferrari emphasized that the medical team had placed Maradona in a situation of abandonment by leaving him to his fate. The treatment was described as anachronistic, with two leaders and independent communication channels.
Doctor Pedro Di Spagna is exempt from prosecution because he visited Maradona only once.
Maradona died on November 25, 2020 while undergoing home treatment, where the care was deemed negligent by the prosecution.
